1. Who provides this service
xauticker.com is operated by C. Kerger, of 1691 Oakdale Ave, San Francisco, CA, 94124, United States, reachable at info@xauticker.com and (415) 647-8134.
2. What the service is
XAU Ticker publishes indicative precious-metal prices and tools for working with them: a rate board, charts, a value calculator and browser-local price alerts. It is provided free of charge, as an information service and nothing more.
XAU Ticker is not a bank, broker, investment firm, payment institution or bullion dealer. We do not hold client money, execute orders, arrange transactions, provide custody, or introduce you to anyone who does.
3. No financial advice
Nothing on this site is investment advice, a personal recommendation, a solicitation or an offer to buy or sell any metal, security, derivative or financial instrument. We do not know your circumstances and we are not authorised to advise you on them. Decisions you take on the basis of what you read here are yours alone, and you should take independent professional advice before acting.

4. Accuracy and availability
Our rates are derived, not quoted — the methodology page sets out exactly how. We take care to make them correct and to label their freshness honestly, but we provide them "as is" and "as available", without warranty of any kind, whether express or implied, including as to accuracy, completeness, timeliness, or fitness for a particular purpose.
Specifically, we do not warrant that:
- prices are correct, current, or match any exchange, benchmark, fixing or dealer quote;
- the service will be uninterrupted, error-free, or free of delay;
- our upstream sources will remain available or accurate;
- the site will remain available in its current form, or at all.
We may change, suspend or discontinue any part of the service at any time without notice.
5. Acceptable use
You may read the site, and use its figures for your own private and internal purposes. You must not:
- scrape, crawl or automatically query the site at a rate that burdens it, or circumvent any rate limit;
- redistribute, resell or republish our rates as a commercial data feed, or present them as your own;
- present our figures as an official benchmark, fixing or exchange price;
- use the site to break the law, infringe anyone's rights, or interfere with its security or operation;
- remove or obscure any attribution, disclaimer or notice.
Reasonable quotation with a clear credit and a link back to xauticker.com is welcome. If you want a data feed or a licence for something broader, ask us.
6. Third-party data and links
Our figures are derived from third-party sources, credited on the methodology page. We do not control those sources and are not responsible for their accuracy or availability. Links to external sites are provided for convenience and are not an endorsement; we are not responsible for their content.
7. Intellectual property
The design, text, code and presentation of this site are owned by C. Kerger and protected by copyright. Raw market prices are facts and are not claimed as our property; the selection, derivation and presentation of them is.
8. Liability
To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or reliance on, this site. That includes trading and investment losses, losses from acting on an incorrect, stale or unavailable rate, loss of profit, loss of data, and any indirect or consequential loss.
Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded — in particular liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for wilful misconduct. If you are a consumer, your statutory rights under the consumer law of your place of residence are unaffected by these terms.
9. Changes to these terms
We may revise these terms. The current version is always at this URL, with the date of the last change shown above. Continuing to use the site after a change means you accept the revised terms.
10. Governing law and jurisdiction
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California. If you are a consumer resident in the European Union or the United Kingdom, you may also bring proceedings in the courts of your country of residence, and you retain the protection of the mandatory provisions of the law of that country.
11. General
If any provision of these terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the privacy policy and the disclaimer, are the entire agreement between us about the site.
